W. Morrow, Clerk I, Zachariah Schnell, of the City of Janesville, in the County of Rock, in the state of Wisconsin, being of sound mind and memory, do make, publish and declare this my Last Will and Testament in manner following: First, I give, devise and bequeath to my wife Moneka Schnell, all of my estate both real and personal, of every name, nature and description, and wherever situated. To have and to hold the same, to her, her heirs and assigns forever. Provided however, that in case my wife shall die intestate, my daughter, Ferdinanda Horn shall have an equal share with myother children in so much of my said estate as my wife shall die siezed & possessed. Second, I do hereby nominate and appoint my said wife Moneka Schnell, sole Executrix of this my Last Will and Testament, and I do hereby revoke all former wills by me made. In witness whereof, I have hereunto set my hand and seal this 26th day of March A.D. 1888. Zachariah Schnell (seal) The above instrument, consisting of one sheet, was at the date thereof, signed, sealed, published and declared by the said Zachariah Schnell to be his Last Will and Testament, in presence of us, who at his request, in his presence and in the presence of each other, have subscribed our names as witnesses thereto. O. P. Meyer, of Janesville, Rock Co., Wis. William Clark, of Harmony, Rock Co., Wis. State of Wisconsin - County Court for Rock County In the matter of the Estate of Zachariah Schnell, deceased, testate} in probate. At special May Term, 1888, held May 15th, 1888. An instrument in writing, bearing date the 26th day of March, 1888 and purporting to be the Last Will and Testament of Zachariah Schnell, of City of Janesville, in said County, having been delivered into said Court, on the 13 th day of April 1888. And, on petition of Moneka Schnell, an order having been made, by said Court on the 13th day of April 1888, appointing a time and place for taking proof of said instrument. And said petition and said instrument having been this day brought on for hearing, and proof, at the time and place so appointed therefor: and it appearing, by due proof filed in said Court, that due notice of the time and place so appointed, has been given as required by law and said order: John Nichols appearing as Guardian ad litem for Albert Schnell, a minor interested in said estate. And no person appearing to contest the Probate of said Insrument, and the same having been duly proved by the testimony of O. F. Meyer one of the subscribing witnesses thereto, by which Testimony it appears that the said instrument was signed by the said Zachariah Schnell and attested and subscribed in his presence by two competent witnesses, and was executed in all particulars as required by law, and that said Zachariah Schnell, was of sound mind at the time of the execution thereof. Now, therefore, on motion of said petitioner, it is ordered, that the said instrument be and the same is hereby admitted to probate and allowed as and for the last Will and Testament of the said Zachariah Schnell. And it is further ordered, that Letters Testamentary as Executrix and as sole legatee and devisee be granted to Moneka Schnell of City of Janesville in said County, upon the giving and approval of a bond, as sole Executrix & as sole legatee and devisee as required by law in such cases, in the sum of two thousand dollars. Prichard, Clerk of the County Clerk within and for the County and State aforesaid, do hereby certify that I have compared the above and foregoing copy of the Last Will and Testament of Zachariah Schnell, late of the City of Janesville, in said County, deceased, together with the Judgement of Probate thereof, with the original thereof, now on file and of record in said Court, and that the above and foregoing is a full, true and complete transcript of such Will and Judgement of Probate and of the whole thereof, as the same so remains of record in the said County Court. In Testimony Whereof, I have herehunto set my hand and affixed the seal of said Court, at my office in the City of Janesville, in said County, this 19 th day of June AD 1893. (Seal) A. E. E. Prichard, by whom the foregoing attestation was made, was at the time of making the same, and is now, the Clerk of said Court, as to all whose acts as such full faith and credit should be given as well in the Courts of this jurisdiction as elsewhere; that the seal thereto attached is the seal of the said County Court, and which said attestation so made by him is in due form of law, and that he was entitled to make the same.
