Pettys filed April 9, 1891 at 10 am J. W. Clerk by G. W. Wells, deputy In the name of God Amen. I Amanuel C. Pettys of the County of Morrow, State of Oregon of the age of 55 years, and being of sound and disposing mind and memory, and not acting under duress, menace, fraud or undue influence of any person whatsoever, do make, publish and declare this my last will and Testament, in manner following, that is to say: First, I direct that my body be decently buried with proper regard to my station and condition in life and the circumstances of my estate. Secondly, I direct that my executrix hereinafter named as soon as she has sufficient funds in her hands, pay my funeral expenses and the expenses of my last sickness and the allowance made to my family. Thirdly. I give and devise to my said wife Katie Pettys all those certain pieces or parcels of land lying and being in Morrow County, State of Oregon, described as follows to wit, the South « North East 1/4 and the South « of the North West 1/4 of Section six in Township one South of Range Twenty Five East the same being known as the A. C. Pettys Timber Cul;ture, also a quarter section of land lying on the north sid eof said section six in Township one south of Range 25 East as aforesaid and being two eighty acres lots lying end to end along the whole north side of said section six, the same being known as the A. C. Pettys preemption claim. Together with all the hereditaments and appurtenances thereto belong or in any wise appertaiing to have and to hold the premises above described to the said Katie Pettys to use and dispose of for the mutual good of herself and our children, so long as she remains my widow; otherwise the said property shall be divided equally between our children share and share alike. Fifthly. I give and devise allt he rest residue and remainder of any real estate of every name and nature whatsoever owned by me at the time of my death, to my said wife Katie Pettys. Sixthly. I give and bequeath all the rest residue and remainder of my personal estate, goods and chattels of whatever kind or nature owned by me at the time of my death to my said wife Katie Pettys. Lastly. I hereby nominate and appoint my wife Katie Pettys the executrix of this my last will and testament, and direct that she shall act as such executrix without giving Bonds and I hereby reovk [sic] all former wills by me made. In witness whereof I have hereunto set my hand and seal this sixth day of April A.D. 1891. A. C. Pettys signed and sealed and pubished as, and declared to be his last will and Testament in presence of us who at his request and in his presence and in the presence of each other, have subscribed our names as witnesses thereto.
