Andrews, Clerk In the name of God, Amen: I, Joseph L. Jones of the age of fifty one years and being of sound and disposing mind and memory and not acting under duress, menance, fraud or undue influence of any person whatever, do make and publish and declare this my last will and Testament in manner following that is to say: First = I direct that my body be decently buried with proper regard to my station and condition in Life and the circumstances of my Estate. Secondly: I direct that my executor hereinafter named as soon as he has sufficient funds in his hands, pay my funeral expenses and the expenses of my Last sickness. Thirdly: I hereby give and bequeath and devise all my pesonal and Real property of whatever nature and kind in Klickitat County, Washington Territory, comprising horses, cattle, land and improvements on land to my brother Harry Jones of near Heppner, Or. Fourthly: I give bequeath and devise all my Interests Legal and equitable in and to all my mining claims and lodes in Howling Flat, Sierra County, California and all other of my Real and Personal property in California to my Brother in Law Wm. W. Sim of near Sacremento California. Fiftly. I hereby give bequeath and devise all my interest in and to the present railroad claim on which Mrs. Emma Kilcup now resides to said Mrs. Emma Kilcup. Sixthly: I hereby give and bequeath and devise all the rest of my property Real and personal, cash and notes equally half and half between my said Brother Harry Jones and Mrs. Emma Kilcup. Seventhly: I hereby declare pubish and expressly provide that in case Mrs. Emma Kilcup (who is now a widow) marries again before my death, she the said Mrs. Emma Kilcup is in such event to only receive my interest only in the said Rail Road claim on which she now lives and no more of my Real or Personal property or Estate whatsoever or at all, and that in such event the whole of my Real and Personal property, cash and notes is to become the sole property of my said Brothe rHarry Jones only and I do hereby will declare and upon said condition make known the same. Eighthly: I do hereby give bequeath and devise to my wife Laura Jones the sum of Twenty Five dollars and no more and hereby will and declare that she shall not be entitled or have any of my property whatsoever except said sum of Twenty Five Dollars. My reasons for so doing are that she has proven herself to be a vile, intrue, drunken and profane wife wholly unfit as a companion for any decent man and a disgrace to her sex, she having threatened to kill, poison, burn and otherwise injure me and has rendered my Life unhappy and so much so that we cannot live again together as man and wife. Lastly: I hereby nominate and appoint my said brother Harry Jones of near Heppner Oregon the Executor of thsi my last will and Testament without bonds, and hereby revoke all former wills by me made. In witness whereof I have hereunto set my hand and seal this 8th day of May A.D. 1888. In presence of Joseph L. Jones (seal) witnesses below. The foregoing instrument consisting of two pages besides this was at the date hereof by the said Joseph L. Jones signed and sealed and published as, and declared to be his last will and Testament in presence of us who at his request and in his presence and in the presence of each other have subscribed our names as witnesses thereto. Leezer, residing at Heppner, Oregon Now on this 8th day of May 1888, personally came Joseph L.Jones the above name person personally known to me and subscribed and acknowledge the above to be his last Will and Testament.
